"There is No Substitute For Experience."

The police officers commonly use roadside field sobriety tests ("FSTs") in DUI investigations in order to determine whether a driver is under the influence of alcohol. Typically, these tests consist of a battery of 3-5 excercises, such as walk-and turn, one-leg stand, "nystagmus" ("follow the pencil with your eyes"), finger-to-nose, alphabet recitation, "Rohmberg" (eyes-closed-position-of-attention), etc. It may be subjectively decided by the officer that whether the individual "failed", or the officer may decide it after applying recent federal "standardized" scoring.

These DUI tests possess an aura of scientific credibility. Unluckily, despite of all the facts, these tests have no real basis in science and they are almost useless in a drunk driving case.

Third, the circumstances and the conditions under which the field sobriety tests are taken themselves guarantee that the person will definitely fail them: usually when a person is driving late at night, possibly cold, along a graveled or sloped roadside, with bright headlights from passing cars (setting up wind waves), the officer’s flashlight and patrol car’s strobe and headlights that are providing the lighting are such conditions that make a person nervous and at that time if the tests are given to a person who is already nervous, frightened and completely unfamiliar with the tests then the chances of his failure in the test becomes too high.

First, as it is known by any traffic officer or DUI attorney that the decision to arrest is made at the driver’s window; the FSTs that are given are supposedly to determine probable cause to arrest. These tests are actually taken for the purpose of gathering evidence.

Second, since the officer has already made up his mind, the subjective decision of an officer as to whether a person passed or failed field sobriety tests is suspect: as dealing with any human, he will "see" only those things that he expects to see.

Because you were charged with DUI in Elkton, Speeding, Driving on a Suspended License or Radar does not mean the State can prove their case. While most police officers perform their tasks properly, there are many instances when their acts, omissions, or failure to comply with detailed procedures when giving a ticket, or making an arrest, creates a valid and enforceable defense to enable your case to be dismissed prior to trial.
